Staff Charter

Introduction

This Staff Charter sets out the responsibilities of Rainbow Club Australia and its Staff in relation to employment procedures.

This Charter is to be read in conjunction with the Fair Work Act 2009, National Employment Standards, and in the case of Swim Instructors: The Fitness Industry Award, Club Manual and the Instructor Manual/Swim the Rainbow. Copies of these manuals can be obtained from the General Manager at info@rainbowclubaust.com.au.

1. Equal Employment Opportunity, Equity and Diversity
Rainbow Club Australia is committed to providing all employees with a fair and equitable working environment, free from any form of discrimination. Rainbow Club Australia will apply the principles of Equal Employment Opportunity (EEO) .
2. Recruitment, Selection and Appointment of Staff
Rainbow Club Australia will plan strategically to meet the organisation’s requirements for staffing and will conduct recruitment and selection for vacant staff positions to implement the Business Plan and as agreed by the Board from time to time.
The recruitment and selection process is subject to confidentiality and information about all applicants must be treated with respect and sensitivity. All details disclosed in applications and during interviews are to remain confidential.
A satisfactory Working with Children Check must be completed prior to the appointment of any Instructor or employee working directly with children.
Satisfactory referee checks must also be completed prior to the appointment of any new employee.
Unless otherwise required by legislation, a satisfactory Police Check must be completed prior to employment, for all staff employed into a senior role.
Prior to commencing work, new staff members will be given:

• a letter confirming the offer of employment and including the Code of Conduct (Appendix 1)
• a copy of their Position Description (as per template in Appendix 2)
• a copy of the Fair Work Information Statement (Appendix 3)

3. Salaries and Wages
Rainbow Club Australia wage levels will be as agreed upon by the Board from time to time with a minimum being as prescribed in the Fitness Industry Award.

4. Superannuation
Rainbow Club Australia will pay superannuation as prescribed in the Superannuation Guarantee (Administration) Act.

5. Working Hours/Flexitime/Overtime
Instructors are employed on a casual basis with shifts as agreed with Rainbow Club Management.

Administrative Staff are employed in accordance with their contract which will indicate the expected working hours and/or flexibility allowed within the position.

6. Leave Entitlements
Leave entitlements for permanent members of staff will be in accordance with their contract, but not less than the National Employment Standards as set by the Fair Work Ombudsman. (Appendix 4)

7. Position Descriptions
Rainbow Club Australia Position Descriptions as developed from time to time, will be in accordance with template in Appendix 4.

8. Workplace Health and Safety
Matters relating to Workplace Health and Safety will be managed in accordance with Rainbow Club Australia’s Workplace Health and Safety Policy which is available on the Website

9. Travel
It may be necessary from time to time for Rainbow Club Australia employees to travel from their normal place of work to another location in the course of carrying out their duties. Application may be made to the General Manager for reimbursement of the reasonable costs in relation to such travel. As far as possible and practical, employees are encouraged to claim travel expenses in their annual tax return. In cases where a private motor vehicle is approved for travel, reimbursement will be in accordance with Australian Taxation Office guidelines.

10. Higher Duties/Secondments
The General Manager will have the discretion to determine whether a position should be filled temporarily by offering an existing staff member the opportunity to undertake higher duties and to establish an appropriate higher duties allowance.

11. Jury Duty
In the case of a permanent staff member being required to undertake Jury Duty, the staff member will be paid the difference between their normal salary and the jury allowance for a maximum of 10 days.

12. Grievance Procedures
Matters relating to a Grievance will be managed in accordance with Rainbow Club Australia’s Managing Complaints and Grievances Policy as contained in the Club Manual and on the Website

13. Performance Management and Review
Rainbow Club Australia believes that performance management and review is an important component of supporting staff in their work, ensuring accountability for work performed and identifying the professional development needs of staff.
Rainbow Club Australia is committed to ensuring that all staff have a clear understanding of the work they are required to complete, are provided with adequate direction and support in their work, and are accountable for the quality and outcomes of their work.
All Administrative Staff in Rainbow Club Australia will take part in an annual review process.

14. Disciplinary Procedures
Matters relating to Staff Discipline will be managed in accordance with Rainbow Club Australia’s Managing Complaints and Grievances Policy.

15. Termination of Employment

Matters relating to Termination will be in accordance with employment legislation or as outlined in individual contracts.
16. Redundancy

Matters relating to Redundancy will be in accordance with employment legislation .

17. Workers Compensation

Work related accidents are covered under Worker’s Compensation insurance.

18. Letters of Offer/Contract Templates
Rainbow Club Australia Letters of Offer/Contracts as developed from time to time, will be in accordance with template in Appendix 1.

19. Intellectual Property
Any literary work, computer program, invention, design, patent, copyright, trademark, improvement or idea developed by an employee in the course of employment by Rainbow Club Australia is the sole property of Rainbow Club Australia, and Rainbow Club Australia will, unless otherwise agreed, have the exclusive right to use, adapt, patent and otherwise register it.

20. Confidential Information
The employee will not divulge any confidential information about Rainbow Club Australia, its employees, volunteers or members either during or after the term of their employment.

APPENDIX 1
Template 1: Instructor Employment Letter

Rainbow Club welcomes you as an Official Rainbow Club Instructor!
You are joining a network of clubs throughout NSW. We are all very proud of what Rainbow Club has achieved over the last 20 years.
Commitment
When you take on a role with Rainbow Club, you take on a commitment to be available for an agreed time every week for the 10 weeks of a school term. This is generally on a Saturday or Sunday. Young children with a disability will be depending on you, and for many this half hour session is a highlight of their week. Your nonattendance impacts on the child you are instructing, other instructors and the children that other instructors are teaching.
Our clubs are managed by volunteers who are usually parents of children in the club. It makes their job and the smooth running of the club easier, if they have reliable instructors on whom they can rely.
Your relationship with each child is individual and important to them, so your ongoing commitment to the club and teaching the children with patience and skill is appreciated.
Qualifications
Rainbow Club insists that all instructors have the basic Teacher of Swimming and Water Safety (TSW) qualification from Austswim (or similar). We also encourage all instructors to obtain the Access and Inclusion level accreditation and, through our partnership with Austswim, we can arrange for Rainbow Club instructors to attend a course near them, free of charge. It is your responsibility to ensure that your qualifications are up to date.
Working with Children Check
All NSW Rainbow Club instructors must provide a Working With Children Check No to the General Manager of Rainbow Club Australia for verification on the NSW Commissioner for Children website.
Employment Status and Rate of Pay
All Rainbow Club instructors are employed on a casual basis as required. Each occasion that you work will be a separate contract of employment which ceases at the end of that engagement. The duties of this role are in the attached Position Description. The terms and conditions of your employment will be those set out in the Fitness Industry Award 2010 (http://www.fwc.gov.au/documents/documents/modern_awards/pdf/MA000094.pdf) and applicable legislation. This includes, but is not limited to, the National Employment Standards in the Fair Work Act 2009. (http://www.fairwork.gov.au/Employee-entitlements/national-employment-standards ) Other conditions relating to your employment are detailed in Rainbow Club Australia’s Staff Charter which is available on the Website.

The rate of pay is $30 per hour including the applicable casual loading. You will be paid fortnightly into your nominated bank account. Superannuation payments in accordance with the Superannuation Guarantee (Administration) Act 1992 will be paid on your behalf into your nominated Superannuation Fund.
You are required to complete a Tax File Declaration (available from all newsagents) and send it to the General Manager of Rainbow Club Australia, PO Box 432, Brighton-le-Sands NSW 2216.
Most Rainbow Clubs operate a sign in/sign out timesheet at the pool and pay amounts are calculated by reference to the sign in/sign out sheets.
Safety and Rules around the Pool
Rainbow Clubs are bound by the rules and regulations of each pool we use and these are on display at the pool. Please familiarise yourself with these rules and ensure that you obey them in their entirety.
As a Rainbow Club Instructor you agree to abide by the Instructor Code of Conduct.

As a Rainbow Club Instructor you agree to:

Behave professionally and ethically, in a manner free from harassment and bullying, and accept responsibility for your actions.
Commit to the mission and goals of Rainbow Club and work all agreed shifts so as to provide the best possible service to Rainbow Club members.
To the best of your ability, ensure the safety, health and welfare of children in the club and other instructors.
Provide a balanced program of swimming and water safety.
Be familiar with the goals of the child you are instructing(or their parent) and support them to achieve their goals.
Modify teaching techniques to cater for the disability of the individual.
Treat all children and parents with courtesy and respect.
Maintain your qualification/accreditation qualification with Austswim (or similar).
Abide by all Rainbow Club Australia Policies and Procedures as detailed on our Website.

Commencement of your first shift will be deemed to constitute acceptance of this offer of employment and agreement to abide by the Workplace Health and Safety requirements of the Pool at which you are working. In anticipation, welcome to the team.
